Terms and conditions of sale

1. Who I am

Nostalgic Artprints is a trade name of Etienne Bervoets, Heerbosstraat 26, 3583 Beringen (Paal), Belgium. Company number 0637.654.442 · VAT BE 0637.654.442. Small business under the VAT exemption scheme – no VAT charged. E-mail: info@nostalgicartprints.eu.

2. When these terms apply

These terms apply to every order placed via nostalgicartprints.eu. For Christmas cards, short films and other custom work for clubs, companies or municipalities, I make a separate quote. Whatever that quote says takes precedence over these terms.

3. Designs

• When you send me an old postcard or photo, I make at least four designs. They are free and without obligation: if you don't like any of them, you pay nothing.
• I work with digital techniques, AI included, and then refine every image by hand.
• The designs on your screen are as faithful as possible. Colours on canvas or paper may differ slightly from what you see on your screen.

4. Prices

• All prices are in euros. No VAT is charged (VAT exemption scheme for small businesses).
• Shipping within Belgium and the rest of the EU costs €12 per order (framed paper in 70 × 100 cm: €30). Each extra print in the same order costs €3 more.
• The price that applies is the one in the confirmation you receive by e-mail.

5. Ordering and payment

• You choose a design, a material, a size and possibly a frame. I send you a confirmation with an order number, the total price and a payment link.
• You pay via that link (PayPal, with or without a PayPal account) or by bank transfer to account BE80 0013 3486 3577 in the name of Etienne Bervoets. Please quote your order number with a bank transfer.
• The sale is concluded as soon as you have paid. Only then do I send the order to print.

6. Delivery

• Your artwork is printed by my print partner and sent directly to the address you provide.
• I deliver to Belgium and the other countries of the European Union, usually within 10 working days of your payment.
• If delivery is not possible within 30 days, I will let you know and you may cancel the order free of charge. You will then get a full refund.
• The risk for the parcel passes to you once you have received it.

7. Right of withdrawal

Custom works. Works I make especially for you – from your own postcard or photo, or with a place name or text of your choice – cannot be returned after payment. The statutory 14-day cooling-off period does not apply to such custom work (Article VI.53, 3° of the Belgian Code of Economic Law). That is why you see the designs first and only pay after you have chosen.

Other works. If you order a work from the gallery or the collection without any personal adaptation, you may withdraw from the purchase within 14 days of receipt, without giving a reason.

• Let me know by e-mail within those 14 days. You may use the model form below, but you don't have to.
• Return the work undamaged and well packed within 14 days after that to Heerbosstraat 26, 3583 Beringen, Belgium. The cost of returning it is yours.
• I refund the full amount, including the original shipping costs, within 14 days of receiving the work back, using the same method you paid with.

8. Damage and guarantee

• If your work arrives damaged or has a printing fault, send me a photo within 3 days of receipt. I will provide a new print free of charge.
• In addition, as a consumer you always have the statutory two-year guarantee for defects that existed at delivery. Report a defect within two months of discovering it.

9. Images and copyright

• By sending an image, you confirm that you are allowed to use it. Postcards more than seventy years old are usually free to use.
• The designs I make remain my work. You may freely hang, give away or sell your print, but you may not reproduce the design yourself or use it commercially without my permission.
• I only show a design I made for you as an example on my website or social media if you agree.

11. Complaints

• If you are not satisfied, let me know at info@nostalgicartprints.eu. I reply within five working days and look for a solution together with you.
• If we cannot reach agreement, you can contact the Belgian Consumer Mediation Service (consumentenombudsdienst.be).
• These terms are governed by Belgian law. If you live in another country, you keep the protection that the law of your country gives you as a consumer.
